The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Team Investment and a Will to Win
The owner disclosed operational insights of his 23XI team, saying he invested $40m of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. I felt as far as the sport required examination through a new lens.”
Central Issue: Franchise System and Contract Pressure
At issue is the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for an hour and exited the courthouse to a media frenzy, with fans and media clamoring for a glimpse or a photo of the sports legend.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is unlawful to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who testified before Jordan, are details from September 2024. She recounted a frantic and emotional six hours where the racing circuit told teams they must sign a charter agreement extension. The document spanned over a hundred pages detailing pay for chartered teams and a guaranteed entry in every race.
A Refusal to Sign
Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.
The Bottom Line: Winning
But in the end, the pushback against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Success.
“Denny convinced me adding a third car improved our chances to win,” he testified, sharing that he bought a third charter last year for $28m amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the timing of the signature deadline didn’t sit well.
According to her, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
